BP Claims: To Object or Not Object to the BP Settlement.

By David Schexnaydre, Esq.

What's a business owner with a BP claim to do: object or not object to the BP Settlement?  While the States of Louisiana and Mississippi and groups of fishermen (fishers) object to the terms of the Deepwater Horizon Settlement on perhaps legitimate grounds that the BP Settlement Fund does not adequately address future damages to the "Seafood Claimants," the BP Settlement Fund offers an opportunity for many other classes of businesses in the entire states of Louisiana, Mississippi, Alabama, parts of Gulf Coast Texas, and all of Gulf Coast Florida with BP claims to participate in a system that does not require a showing of direct causal relationship between the BP Oil Spill and a decline in income (which would be difficult to prove in court), and allows for the use of damage multipliers (which would be impossible to use in court).  Thus, for many companies who have potentially large BP Claims, such as construction companies, contractors, small business owners, consultants, engineers, professional services, real estate agencies and agents, retail outlets, service providers, car dealerships, supply houses, and more, the BP Settlement Agreement represents the best chance they will ever have to make the most money for the least amount of proof.  Additionally, the claim can be evaluated, submitted, and paid very quickly (estimated at four to six months) and the contigency fee paid to the business owner's attorney is much less than if the claim ended up in litigation.  Our recommendation is that if you are not in the seafood industry, don't object or opt-out.  Rather, make your claim now and get back to what you do best -- running your business.
