Appeals for "Preservation Purposes" Will Not Delay Payment

While we are all waiting for the U.S. Supreme Court to decide whether to grant or deny BP's Petition for Writ of Certiorari, BP will apparently continue to appeal every single Eligibility Notice issued by the Claims Administrator on Business Economic Loss claims.  BP will readily admit in many of those appeals, however, that the appeal is being made for "preservation purposes" so that BP does not waive any of the arguments currently being made before the Supreme Court.  

While certainly frustrating to see yet another Notice of BP Appeal, claimants can take comfort in the fact that these "preservation purpose" appeals will not result in much of a delay in payment of the claim.  If the only ground for the appeal is that it is being made for "preservation purposes," the Claims Administrator has advised that it will move the claim immediately to payment processing.

In reality, an appeal for "preservation purposes" will delay the payment of a claim for about a week, but that is much shorter than the two to three months a regular appeal can delay payment on a claim.
