Vaccine Injury Compensation Program: Know the Facts

The administration of vaccines is extremely important to public health. In fact, each year in the U.S., 250 million vaccines are administered to protect individuals and the general public from potentially deadly diseases.

While most children and adults who receive vaccines experience no negative side effects, that isn't always the case. With a small fraction of vaccines, injuries occur, although the injuries are usually not due to the vaccine itself, but to the way the shot was administered.

The U.S. government has a program for compensating victims of vaccine injuries.

If a vaccine is administered too high on the shoulder, the person receiving the vaccine could suffer Shoulder Injury Related to Vaccine Administration --commonly called SIRVA. This can be a very serious and painful injury, potentially resulting in long-term disability.

While relatively rare, these injuries are covered by the Vaccine Injury Compensation Program (VICP), which Congress created more than 25 years ago.

The VICP is a no-fault system for providing injury victims with the compensation they need to move on with life. The system operates on a no-fault basis in order to protect vaccine manufacturers from overwhelming lawsuits that could hinder or stop altogether the production of vaccines that protect all of society.

Important to note: The VICP has become a complicated system, and vaccine injury victims should seek the assistance of an attorney with experience in handling these cases.

The VICP is funded by a minimal tax paid on each vaccine, and one key aspect of the program is that it pays for victims' attorneys' fees. In other words, if you bring a claim through the VICP, you are not responsible for legal fees.
